Federal Court Mandates Release of Kilmar Abrego Garcia from ICE Custody

A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without lawful basis.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his return to the United States to face alien smuggling charges, he was held in immigration custody.

In her decision, the court pointed out that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

The court challenge involve disputed claims. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
